Citizens’ Appeals
The right for appeal
According to the Law of Ukraine “On Citizens’ Appeals” right to appeal to the state authorities, local authorities, associations of citizens, enterprises, institutions and organizations regardless of ownership patterns, media and officials according to their functional responsibilities with comments, complaints and suggestions concerning their statutory activities, with application or petition for the implementation of their socio-economic, political and personal rights and legal interests, and complaining about violating them, are entitled to appeal citizens of Ukraine, and persons who are not citizens of Ukraine, if otherwise stipulated by international treaties. Military personnel, officers of law enforcement and public safety, as well as common soldiers and command staff of the State Penitentiary Service of Ukraine have the right to file appeals that are not related to their official duties.
Requirements for appeals

Appeals are addressed to governmental bodies and local authorities, enterprises, institutions and organizations regardless of ownership patterns, associations of citizens, and officials, whose authorities can solve the issues raised in the appeals.

 

The appeal shall contain the name, first name, middle name and address of the applicant, whom archive sends a response. The appeal should contain the subject matter, comments, suggestions, statements or complaints, requests or demands.

 

Appeal can be oral (expressed at personal appointment) or written, sent by mail (including email), or transferred to the appropriate national authority, institution personally or through an authorized person, if those credentials are in accordance with current legislation.

 

Appeals may be submitted by one person (individual) or a group of persons (collective). Written application must be signed by the applicant(s) with the date. In reviewing the applications and appeals, appeals of less socially protected groups and individuals who have benefits, established by legislation, are executed first.

 

Citizens have the right to appeal to the state authorities, local governments, enterprises, institutions and organizations regardless of ownership patterns, associations of citizens, officials, in Ukrainian or another language acceptable to the parties.

 

Applications, duly and legally presented, are subjects to mandatory acceptance and consideration.

The processing time of citizens’ appeals

According to the Law of Ukraine “On Citizens’ Appeals” response to the request shall be made no later than one month from the date of receipt, and immediately to those that do not require additional study, but not later than fifteen days from the date of receipt. If issues raised in the appeal can not be resolved within one month, the head of the body, enterprise, institution, organization, or his deputy define necessary time for its review, and report it to the person who filed the appeal. The entire term for resolving issues raised in the appeal, may not exceed forty-five days.

 

Upon reasonable written request of the citizen, review period may be reduced from the term defined in this Article.

 

Responses to appeals, providing archival information necessary to ensure social protection of citizens are implemented in state archives for free.

Personal reception of citizens

Guidance and other officials of public authorities, local governments, enterprises, institutions and organizations regardless of ownership patterns, associations of citizens are bound to carry personal reception of citizens.

 

All appeals of citizens at the personal reception are registered. If it is impossible to solve the question raised in oral appeal, it is treated in the same manner as written appeal. Results of consideration are informed to the citizen in written form or orally, depending on citizen’s desire.

Thematic appeals

TsDAZU serves appeals for documents stored in the archive. It provides information about the availability of documents on a particular problem, about ascertainment or proof of some fact, event, and, if the documents on this topic are present, the archive makes a list of them. In case of the requested documents’ absence, the archive provides the applicant reply about the lack of necessary documents and recommendations to apply to the profile archive.
